1. Scope of application
The use of this website and the business relationship between emmavonzermatt.ch, represented by Verlag König, Sabine König, Alte Badenerstrasse 5, 8173 Neerach and its customers are governed by the following General Terms and Conditions (GTC), in the version currently available and valid at the time of opening the website or ordering goods. The offer on this website is exclusively addressed to customers domiciled in Switzerland or Liechtenstein.
A customer is any natural or legal person who has a business relationship with emmavonzermatt.ch. The GTC, the terms of delivery and payment as well as the provisions concerning data protection may be subject to periodic changes. emmavonzermatt.ch invites you to read these provisions carefully each time you visit the site and each time you order goods.
These GTC are exclusively applicable. Any contrary, complementary or divergent conditions to these GTC must be expressly confirmed in writing by emmavonzermatt.ch to be valid. By using this website or by ordering goods, the customer confirms that he/she accepts these GTC in their entirety, including the delivery and payment conditions.

3. Prices
The prices of emmavonzermatt.ch are net prices in Swiss francs (CHF). Shipping costs, which include material costs, are charged in addition and must be paid by the customer. The shipping costs are shown separately in the order process (shopping cart/enter postal code). From an order value of CHF 100.00 onwards, shipping costs are no longer charged.
Subject to technical changes, errors and misprints, emmavonzermatt.ch may change prices at any time and without prior notice. The sales prices do not include any consulting or support services.

4. Conclusion of the contract
The offers presented on this website are a non-binding invitation for the customer to order products and/or services from emmavonzermatt.ch. By placing an order via this website, and by accepting these GTC, the customer makes a legally binding offer for the conclusion of a contract. emmavonzermatt.ch then sends an automatic order confirmation by e-mail, which confirms that the customer’s offer has been received by emmavonzermatt.ch. Orders placed are binding on the customer. Unless otherwise stated, there is no right of return or cancellation.
The contract is concluded as soon as emmavonzermatt.ch sends an acceptance e-mail confirming the shipment of the ordered products or services.
Orders are only delivered after full payment has been received and provided that the goods are available. If, after the conclusion of the contract, it turns out that the ordered goods cannot be delivered or cannot be delivered in full, emmavonzermatt.ch has the right to withdraw from the contract in whole or in part. If the customer’s payment has already been received by emmavonzermatt.ch, the payment will be refunded to the customer. If no payment has yet been made, the customer is released from his obligation to pay. In case of cancellation of the contract, emmavonzermatt.ch is not obliged to make a replacement delivery.

5. Payment options and retention of title
The customer has the payment options indicated in the order process.
emmavonzermatt.ch reserves the right to exclude customers from certain payment options or to demand advance payment without giving reasons. In case of late payment by the customer, emmavonzermatt.ch can charge interest on arrears of 5% per year as well as a reminder fee of maximum CHF 20 per reminder.
The products delivered to the customer remain the property of emmavonzermatt.ch until their complete payment.

6. Delivery, obligation to inspect, complaints and returns
Up to an order value of CHF 40.00, the delivery costs amount to CHF 10.00. For orders with a total value of CHF 41.00 to CHF 79.00, the delivery charge is CHF 4.50. From an order value of CHF 100.00, delivery is free of charge (delivery is made by non Priority Mail (B Post)). The shipping costs include the material costs.
Deliveries are sent by post to the address indicated by the customer in the order. Invoicing is done by e-mail. With the shipment, the benefits and risks are transferred to the customer, insofar as this is permitted by law.
If the delivery cannot be delivered or if the customer refuses the delivery, emmavonzermatt.ch can withdraw from the contract after notification of a complaint by e-mail to the customer and setting a reasonable deadline, and charge the travel costs.
The customer is obliged to check the delivered goods immediately upon receipt and to report any defects for which emmavonzermatt.ch offers a guarantee immediately in writing, by post or e-mail to the address given in the legal notice.
Returns to emmavonzermatt.ch are made at the expense and risk of the customer. The customer must send the goods in their original packaging, complete with all accessories and accompanied by the delivery note and a detailed description of the defects to the return address indicated by emmavonzermatt.ch in the legal notice.
If, upon examination by emmavonzermatt.ch, the goods are found to have no detectable defect or are not covered by the manufacturer’s warranty, emmavonzermatt.ch may charge the customer for the costs of removal, return or disposal.

7. Warranty
emmavonzermatt.ch strives to deliver goods of impeccable quality. In the event of defects reported in good time, emmavonzermatt.ch guarantees the absence of defects and the proper functioning of the item purchased by the customer for the statutory warranty period, which is generally two years from the date of delivery. It is left to the discretion of emmavonzermatt.ch to provide the warranty by free repair, equivalent replacement or refund of the purchase price. All other claims are excluded.
The warranty does not cover normal wear and tear as well as the consequences of improper treatment or deterioration by the customer or third parties, nor does it cover defects caused by external circumstances. The guarantee for consumable and wearing parts is also excluded.
emmavonzermatt.ch is not in a position to give any assurances or guarantees as to the topicality, completeness and correctness of the data as well as the permanent or uninterrupted availability of the website, its functions, the integrated hyperlinks and other contents. In particular, it is neither assured nor guaranteed that the use of the website does not infringe on the rights of third parties which are not owned by emmavonzermatt.ch.

8. Responsibility
emmavonzermatt.ch excludes all liability, regardless of the legal basis, as well as all claims for damages against emmavonzermatt.ch and any auxiliary persons and agents. 11. Subscribing to the newsletter

In the event of a dispute, only Swiss substantive law is applicable, to the exclusion of conflict of laws rules. The United Nations Convention on Contracts for the International Sale of Goods (CISG, Vienna Convention) is explicitly excluded.
The place of jurisdiction is Neerach / ZH, insofar as the law does not provide for a mandatory place of jurisdiction.
